Terms of Service

1. Acceptance of Terms

By accessing or using NimbusOS services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

NimbusOS provides an email infrastructure platform for outbound agencies that includes automated domain provisioning, DNS management, inbox warmup, and sending tool integrations. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Be at least 18 years old or have legal authority to enter into this agreement

4. Acceptable Use

You agree not to use our services to:

  • Send spam or unsolicited bulk emails
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or harmful code
  • Attempt to gain unauthorized access to our systems
  • Resell or redistribute our services without authorization

5. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in our refund policy. We reserve the right to change pricing with 30 days notice.

6. Data Ownership

You retain ownership of all data you upload to NimbusOS. By using our services, you grant us a limited license to process your data as necessary to provide the services. We will not sell your data to third parties.

7. Limitation of Liability

NimbusOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Termination

Either party may terminate this agreement at any time. Upon termination, your right to access the services will cease immediately. We may retain certain data as required by law or for legitimate business purposes.

9. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the platform. Continued use of the services after changes constitutes acceptance of the new terms.
